A new strategy adopted by the Modisarkaar today is the use of ordinances for linking industrial growth with suitable welfare of the rural population. A case in particular for this is the Land Ordinance 2014. 4 times the land rate is being paid to the persons who own land in rural areas, 2 times the land rate for owners in urban areas and standard compensation for artisans, small traders, fishermen and others who depend on the land. From this, it is clear that the new NDA Govt. wants overall welfare of the country, with gradual equality in standards of living.

My friend Sarfraz, a fact that you are ignoring about the ordinance here is the cost at which development is being offered. First of all, there is no Social Impact Assessment (SIA) of the selling of these lands, which in itself sounds flawed. In the previous Land Ordinance Act of 2013, a 70% agreement of families for land to be used for Public Private Partnerships was available, and so was an 80% agreement for land in private projects, which has been withdrawn now. Ioystead of this, any kind of projects can now be passed in the name of social and rural infrastructure, industrial corridors, and defense production. And since there is no SIA, artisans and others will get very low compensation. So how is this really beneficial?

With the new Land Ordinance of 2014, many top bureaucrats are likely to play mischief, as there is immunity against prosecution. Several projects can be passed by such people and then land can be subsequently sold to high paying real estate developers. On top of that, the innumerable private colleges and schools which dupe parents by providing low quality education at high prices will continue to rise. You know, they will purchase the land and then run their businesses without paying much attention to education.  In other words, India will fall back even more than it already is.

See, the reason an ordinance has been used is because it was important to get this bill passed, especially since NDA Govt. did not hold majority in the RajyaSabha at the time of central elections. Article 123 has been used previously to pass other laws as well. The only way this issue can be solved is that if there is free and fair compensation of all, which is provided under the current ordinance. It is necessary that a central body, similar to the Supreme Court, must get the power to check the viability of a project of a public or private project. Once its necessity is explained, I am sure both parties will not have a problem under this Act.

Ms.Debasmita, do you want more farmer suicides to take place in this country? States such as Maharashtra and Haryana have already witnessed a large number of cases. If land continues to be acquired like this, it is likely that soon every farmer in the country will be left with no other option. The land is inclusive of a farmer’s lifetime of efforts and sacrifices, and you think it will be so easy for him to give it up? And I agree with Aditya that it will be a greater problem as no SIA report is being prepared for this situation. Article or no Article, I am sure this will affect farmers in a big way and they will be left with no other option but protests. How is this the world’s largest parliamentary democracy then?
